Access to justice before the Court of Justice of the EU

The session will offer a practical overview of how litigation works before the Court of Justice of the European Union, covering both actions for annulment and preliminary references. It will explain how to initiate proceedings, key procedural choices, and how written and oral submissions are handled by the Court. Drawing on first-hand experience from inside the CJEU, the session will focus on how to frame persuasive pleas in law, present complex economic and technical evidence effectively, and advocate convincingly at the hearing to maximise the chances of success.

Thomas Reyntjens is a Managing Associate at Linklaters in Brussels. He advises multinational corporates on all aspects of EU litigation and EU competition law, as well as on new regulatory frameworks such as the DMA. Before his current role, Thomas worked as a legal secretary (référendaire) at the General Court of the European Union, where he contributed to the resolution of more than 200 cases, including the first judgments under the Digital Markets Act, the Google AdSense abuse of dominance case, State aid cases on COVID-19 support for EU airlines and numerous precedent-setting banking union rulings. He also worked in the chamber of the General Court that handled the first preliminary references after the reform of the CJEU.
